U.S. Customs and Border Protection published a proposed rule on October 13, 2026, that would obligate rail carriers to send electronic traveler data to the agency before any train crosses the U.S. border in either direction.
The Federal Register filing states the requirement would cover every person on board, crew and passengers alike, for both inbound and outbound trains. Carriers would also be required to file an advance notice of each train's scheduled arrival or departure.
CBP says the rule is designed to strengthen border security while keeping legitimate international rail travel moving.
